While no trustee will deny they hold a duty of care for their scheme members, many trustees are reluctant to go too far down the road of helping scheme members. We will explore the legal principles of trustee decision-making and the process that trustees should follow in order to reach a decision that stands up to legal scrutiny, and then apply these principles and process to a case study covering an employer's proposal to change a defined benefit scheme's indexation measure from RPI to CPI.
